Please read these Terms of Service ("Terms") carefully before using the FishWise mobile application operated by AI4U LLC.

Acceptance of Terms

By downloading, installing, or using FishWise, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the app.

Description of Service

FishWise is a free mobile application that provides:

• AI-powered fish and lure identification from photos
• Community Feed for sharing catches, following anglers, and social interaction
• Spot analysis with species information, regulations, and fishing tips
• Catch logging and tracking
• Lure encyclopedia with 346 lures and baits
• Fishing forecasts and weather conditions
• Fishing regulations information
• Offline access to previously viewed content

Accounts and Authentication

FishWise can be used without an account for core features like fish identification, spot analysis, and catch logging. Creating an account is required to use Community features (sharing catches, following anglers, liking, and commenting).

You can sign in using:

• Apple Sign-In: Authenticates using your Apple ID.
• Google Sign-In: Authenticates using your Google account.
• Email: A passwordless magic link is sent to your email address.

You are responsible for maintaining the security of your account. You must not share your account or allow others to access it. If you believe your account has been compromised, contact us immediately.

Community Features and User Conduct

FishWise includes a Community Feed where users can share catches, follow other anglers, and interact through likes and comments. By using Community features, you agree to:

• Post only content that you own or have permission to share.
• Not post content that is offensive, harassing, threatening, defamatory, or discriminatory.
• Not spam, post advertisements, or engage in deceptive practices.
• Not impersonate other users or misrepresent your identity.
• Not post content that is illegal or encourages illegal activity.
• Not attempt to collect, harvest, or scrape other users' data.
• Respect other users' privacy, especially regarding fishing spot locations.
• Not post content depicting animal cruelty or illegal fishing practices.

We reserve the right to remove any content and suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

User-Generated Content

You retain ownership of all content you create and share through FishWise, including photos, captions, and comments. By sharing content to the Community Feed, you grant AI4U LLC a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce your content within the FishWise app and for promotional purposes.

You may remove your shared content at any time by unsharing or deleting it. Removal may not be immediate from all caches or backups.

By using the app, you also grant AI4U LLC a license to use anonymized and aggregated data to improve our services.

Content Moderation and Reporting

Users can report content or accounts that violate these Terms. We review reports and may take action including content removal, warnings, or account suspension. We are not obligated to monitor all content but reserve the right to do so.

Account Deletion

You can delete your account at any time from the Privacy & Security screen within the app. Deleting your account permanently removes your Community profile, all shared catches, follows, likes, and comments. Local catch data on your device is also cleared. This action cannot be undone.

Accuracy of Information

Fish Identification: While we strive for accuracy, AI-powered fish identification is not 100% accurate. Always verify identification, especially for species that may be dangerous, toxic, or regulated. Do not consume any fish based solely on identification from this app.

Lure Identification: AI-powered lure identification provides suggestions based on visual analysis. Results may not always be accurate. Verify lure details before making purchasing decisions.

Spot Analysis: Location-based information including species lists, fishing tips, and local conditions are AI-generated and may not reflect current real-world conditions. Use this information as a starting point for your own research.

Regulations: Fishing regulations provided in the app are for informational purposes only and may be outdated or incomplete. Always verify current regulations with official state and local authorities before fishing. You are solely responsible for compliance with all applicable fishing laws.

Forecasts: Fishing forecasts are predictions based on weather, lunar, and environmental factors. They do not guarantee fishing success and should not be relied upon for safety decisions.

Offline Mode

FishWise provides offline access to previously viewed content:

• Spot analyses and weather data you have viewed while online are cached for offline access.
• Cached data may become outdated. The app will indicate when you are viewing cached content.
• Fish scanning requires an active internet connection and is not available offline.
• Your saved catches and trip data are stored locally on your device and are always accessible.
• Community features require an active internet connection.

User Responsibilities

You agree to:

• Use the app in compliance with all applicable laws and regulations.
• Obtain proper fishing licenses as required by your jurisdiction.
• Not rely solely on the app for species identification of potentially dangerous or toxic fish.
• Verify fishing regulations with official sources before fishing.
• Not use the app in any way that could endanger yourself or others.
• Not attempt to reverse engineer, decompile, or disassemble the app.
• Not use the app for any unlawful purpose.

Data and Privacy

Your use of FishWise is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the app, you consent to our data practices as described in the Privacy Policy.

Third-Party Services

FishWise uses third-party services to provide its features, including:

• Google AI for fish and lure identification
• Weather data providers for fishing forecasts
• Apple Sign-In and Google Sign-In for authentication
• Supabase for Community data storage and user profiles
• Expo for push notification delivery

We are not responsible for the availability, accuracy, or reliability of these third-party services.

Push Notifications

FishWise may send push notifications for Community activity such as likes, comments, and new followers. You can manage notification preferences within the app's Notification Settings screen, or disable notifications entirely through your device's Settings.

Affiliate Links & Product Recommendations

FishWise is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites and apps to earn advertising fees by advertising and linking to Amazon.com. When you tap product links (such as "Shop on Amazon") within the app, you will be directed to Amazon.com. If you make a purchase through these links, FishWise may earn a small commission at no additional cost to you.

Product recommendations and search results on Amazon are not endorsements. Prices, availability, and product details are determined by Amazon and may change at any time. FishWise does not control and is not responsible for the products, pricing, or fulfillment provided by Amazon.

Intellectual Property

The app, including its content, features, and functionality, is owned by AI4U LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the app without our written permission.

Limitation of Liability

To the maximum extent permitted by law, AI4U LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use of or inability to use the app
• Any errors or inaccuracies in fish identification, regulations, or other information
• Personal injury or property damage related to your use of the app
• Any unauthorized access to your data
• Any interruption or cessation of the service
• Content posted by other users
• Actions taken by other users, including misuse of location information

Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

Indemnification

You agree to indemnify and hold harmless AI4U LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the app, your content, or violation of these Terms.

Termination

We may terminate or suspend your access to the app and Community features at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. You may delete your account at any time as described in the Account Deletion section.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the app or by other means. Continued use of the app after changes constitutes acceptance of the new Terms.
